1. Acceptance of Terms

By accessing, browsing, submitting information through, or otherwise using the website, client portal, or services of Over the Horizon Veteran Medical Consulting (“the Company,” “we,” “our,” or “us”), including by clicking “I agree” where presented, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not use the website or services.

2. Non-Clinical Consulting Services Only

The Company provides independent medical review, documentation preparation, and consulting services only, which may include Independent Medical Opinions (IMOs), Nexus Letters, Disability Benefits Questionnaire (DBQ) non-certifying commentary, and medical record review. The Company does NOT:

• Diagnose medical conditions

• Provide medical treatment or medical care

• Offer telehealth or other clinical services

• Prescribe or manage medications

• Establish a provider–patient or provider–client relationship

All references to “services” refer exclusively to non-treatment consulting and documentation services.

3. No Provider–Client or Provider–Patient Relationship

Use of the Company’s website or services does not create a provider–client or provider–patient relationship. Any consulting clinicians engaged by the Company act solely in an independent, non-treating documentation and review capacity. Clients must seek all diagnosis, treatment, and medical care from their licensed healthcare providers.

4. Not Legal Advice

The Company’s services do not constitute legal advice or legal representation. The Company does not prepare, submit, or appeal VA claims on behalf of clients. Clients are responsible for consulting qualified legal counsel regarding disability claims, appeals, or other legal matters.

5. User Responsibilities

By using the website or services, you agree to:

• Provide accurate, complete, and truthful information

• Submit only records you are legally authorized to share

• Refrain from misrepresenting military service history or medical conditions

• Refrain from submitting altered, fabricated, or misleading records

• Use the website and services in a lawful and ethical manner

6. Intellectual Property and Limited License

Except for client-specific deliverables provided for personal use, all content, materials, templates, logos, designs, and intellectual property on the Company’s website are owned by or licensed to the Company and are protected by applicable intellectual property laws. Clients are granted a limited, non-transferable, non-commercial license to use client-specific deliverables for their intended personal purpose only.

7. Website Use and Restrictions

You agree not to:

• Interfere with or disrupt website functionality or security

• Attempt unauthorized access to systems or data

• Use the website for fraudulent, unlawful, or harmful purposes

8. Electronic Communications

By using the website, submitting forms, or communicating with the Company electronically, you consent to receive communications electronically. You acknowledge that electronic communications may not be fully secure and accept this risk. Electronic communications do not constitute medical or legal advice.

9. Disclaimers

The Company makes no guarantees or representations regarding VA claim outcomes, rating decisions, processing timelines, or appeal results. Any documentation provided is informational and evidentiary in nature and does not control or influence VA determinations.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to use of the website or services, including reliance on documentation provided. Nothing in these Terms limits liability for gross negligence or willful misconduct where such limitation is prohibited by law.

11. Refund Policy

Refunds, cancellations, and payment terms are governed exclusively by the Company’s separate Refund and Cancellation Policy, which is incorporated by reference.

12. Governing Law and Venue

These Terms of Use are governed by and construed in accordance with the laws of the state in which the Company is registered, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be brought in the appropriate state or federal courts located in that state, unless otherwise required by law.

13. Changes to Terms

The Company may update these Terms of Use from time to time. Material changes will be posted on the website or otherwise provided to users. Continued use of the website or services after the effective date of any changes constitutes acceptance of the revised Terms.
